Equitable distribution is not a term that just rolls off the tongue so easily, but the term involves the long-standing presumption that equal distribution of all marital assets and debt between spouses is fair.  There are statutory factors that exist to allow for one spouse to receive a greater share of marital debt or property in an unequal distribution.  Certain property that is acquired by one spouse, during the marriage or prior to the marriage, could be classified as that spouse’s separate property; and at Parker Law, PA, we guide clients through the classification, valuation and distribution process that can become extremely complicated.
